A. A previously conforming nonresidential structure incurring damage by fire, explosion, wind, earthquake, war, riot, or other calamity or act of God, which damage does not exceed 60 percent of its value, as established by the City Manager or designee, at the time of damage, may be reconstructed subject to the conditions in CVMC 19.64.170.

1. Notwithstanding subsection (A) of this section, reconstruction shall not be permitted in the City right-of-way.

B. In no event shall a previously conforming nonresidential structure incurring damage exceeding 60 percent of its value, as established by the City Manager or designee, at the time of damage, be reconstructed or restored to its condition prior to such damage. (Ord. 3153 § 2 (Exh. A), 2010).
