5.56.060 Permits nontransferable.
A. A Tobacco Retailer’s permit may not be transferred from one Person to another or from one location to another. A new Tobacco Retailer’s permit is required whenever a Tobacco Retailer has a change in more than 20 percent Ownership of the Tobacco Retailer or whenever a Tobacco Retailer changes location.
B. Notwithstanding any other provision of this chapter, prior violations at a Tobacco Retailer location shall continue to be counted against the location and permit ineligibility periods shall continue to apply to the location unless:
1. The location has been transferred to the new Owner in an Arm’s Length Transaction; and
2. The new Owner provides the City with clear and convincing evidence that the new Owner(s) have acquired or are acquiring the location in an Arm’s Length Transaction. (Ord. 3417 § 1, 2018).
