Whenever development activity within sensitive biological resources, as identified in the City of Chula Vista MSCP subarea plan, is deemed necessary by order of the City Manager to protect the public health or safety, the City Manager may authorize, without a public hearing, the minimum amount of impact necessary to protect the public health or safety, subject to the following:

A. If the emergency work involves only temporary impacts to sensitive biological resources, a HLIT permit is not required, provided the sensitive biological resources are restored to their natural state in accordance with a revegetation plan approved by the Director of Development Services, or designee. The revegetation plan shall be submitted to the City within 60 days of completion of the emergency work.

B. If the emergency work results in permanent impacts to sensitive biological resources, a subsequent HLIT permit is required in accordance with all regulations of this chapter. The application for the HLIT permit shall be submitted within 60 days of completion of the emergency work. (Ord. 3544 § 1, 2023; Ord. 3004 § 1, 2005).
